QX-Systems complies with the EU Directive 2012/19/EU (WEEE) and the Italian Legislative Decree 49/2014 regarding Waste Electrical and Electronic Equipment (WEEE). We ensure that all electrical and electronic equipment (EEE) placed on the Italian market is managed in accordance with applicable environmental regulations. Where required, we are registered (or will be registered) with the Italian WEEE Register and fulfill our producer responsibility obligations. We guarantee that: Products are properly marked with the crossed-out wheeled bin symbol. Customers in Italy can return old electrical equipment free of charge in accordance with the “1 contro 1” and, where applicable, “1 contro 0” take-back rules. Collection, treatment, recycling, and disposal of WEEE are handled through authorized compliance schemes or certified recycling partners in Italy. General Terms and Conditions QX-Systems Effective Date:03-03-2026 1. Company Information QX-Systems Registered Address: In de betouwstraat 33 6511GB Nijmegen Camber of Commerce Number: 64085856 Email: [email protected] QX-Systems sells products via the MediaMarkt Italy marketplace and other online sales channels. 2. Scope These General Terms and Conditions (“GTC”) apply to all agreements concluded between QX-Systems and customers purchasing products via the MediaMarkt Italy platform. The sales contract is concluded exclusively between the customer and QX-Systems. MediaMarkt acts solely as an intermediary marketplace operator. 3. Product Information Product descriptions, specifications, and images are provided with due care. Minor deviations in color, design, packaging, or technical updates do not constitute a defect. Obvious errors (including pricing errors) may be corrected. In such cases, QX-Systems reserves the right to cancel the order. 4. Prices and Payment All prices include VAT unless stated otherwise. Shipping costs are indicated during checkout. Payments are processed via MediaMarkt’s payment system. Orders may be refused or cancelled in cases of suspected fraud, abuse, or incorrect pricing. 5. Delivery Delivery times are indicative and not binding unless expressly agreed. QX-Systems is not liable for delays caused by carriers, customs, force majeure, or circumstances beyond reasonable control. Risk passes to the consumer upon delivery in accordance with EU consumer law. If incorrect delivery information is provided by the customer, additional costs may be charged. 6. Right of Withdrawal (Consumers) Consumers have the right to withdraw from the contract within 14 days after delivery, in accordance with Directive 2011/83/EU and applicable Dutch law. Conditions: Products must be returned in the same condition as received; Unused and undamaged; Complete with original packaging and accessories. QX-Systems may deduct compensation for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Return shipping costs are borne by the customer unless mandatory law provides otherwise. 7. Refunds Refunds are processed after inspection of returned goods. Refunds are issued via the original payment method. QX-Systems may suspend refunds until goods are received or proof of return is provided. 8. Warranty and Conformity Consumers are entitled to statutory conformity rights under EU and Dutch law. However: No warranty applies in cases of improper use, external damage, unauthorized modification, or normal wear and tear. Liability is limited to the purchase price of the product, unless mandatory law provides otherwise. QX-Systems is not liable for indirect damages, loss of profit, business interruption, or consequential damages, except in cases of intent or gross negligence where liability cannot legally be excluded. 9. Force Majeure QX-Systems shall not be liable for delay or failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, strikes, pandemics, governmental measures, supply chain disruptions, or transport failures. 10. Fraud Prevention and Abuse QX-Systems reserves the right to: Refuse or cancel orders in case of suspected fraud; Refuse returns in cases of abuse of withdrawal rights; Take legal action where necessary. 11. Intellectual Property All trademarks, product names, images, and content remain the property of their respective owners. Unauthorized reproduction is prohibited. 12. Applicable Law and Jurisdiction These Terms and all agreements between QX-Systems and the customer are governed by Dutch law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers residing in another EU Member State, mandatory consumer protection provisions of their country of residence remain unaffected. Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
